Limit of Liability

Submitting any film, print, slide, transparency, negative, art work or digital media to this firm for processing, printing, duplication or other handling constitutes an AGREEMENT by you that any damages or loss by our company or agents, even though due to the negligence or other fault of our company or agents, will only entitle you to replacement with a like amount of unexposed film and processing, or if digital files a like type and size of storage media. Except for such replacement, the acceptance of the film, print, slide, transparency, negative, art work or digital media is without other warranty or liability, and recovery for any incidental or consequential damages is excluded.

If the material being submitted to this firm constitutes a higher origination cost than is covered by the above LIMIT OF LIABILITY, and West Photo Imaging LLC (West Photo Imaging, WPI), is required to accept said material for handling, then this higher amount must be declared in writing at the time the original materials are delivered to West Photo Imaging and before handling commences.  Either an appropriate fee to cover the increased value of insured liability will be negotiated, signed for, and charged to the customer’s invoice for the job, or the customer will be required to furnish to West Photo Imaging documentation of customer's insurance coverage of the item(s) being submitted.  In no event will West Photo Imaging be required to bear the expense of any additional insurance on customer material.

As all dyes and pigments used in color materials, like other dyes, are subject to change in time, and as West Photo Imaging has no control over the conditions of display, storage and/or archiving as performed by the customer, West Photo Imaging will not warrantee any products against any change in color, density or condition.

All Claims against delivered goods and/or services MUST be made within 3 working days of receipt.

Employees of West Photo Imaging are not authorized to change, amend, waive, or otherwise alter the foretasted LIMIT OF LIABILITY.


Copyright Indemnification

West Photo Imaging MUST have on file written authorization from the copyright holder before we will knowingly duplicate, or in any way copy, a copyrighted photograph, article, artwork, etc.  Please call us if you have any questions concerning copyrighted material.


General Sales Policies

OPEN ACCOUNTS

Payment Terms are: NET 30, NET +2%/31 from INVOICE DATE, unless other arrangements have been agreed upon in writing by BOTH parties.  Open Accounts are available to those companies and individuals who have completed an Application for Credit and a Bank Release Form and who meet credit requirements as determined by West Photo Imaging.

Accounts over 30 days Past Due WILL be charged 2% per month Finance Charge on overdue balances.  There is a Minimum Charge per Invoice of $15.00.

Accounts over 60 days Past Due will automatically be place on COD status and will remain so until the entire account is paid in full, at which time the account will be subject to re-evaluation for Open Account status.  West Photo Imaging reserves the right to withhold delivery to the customer of any and all work and original materials should the customer's account be in arrears for a period of more than 60 days Past Due.

West Photo Imaging vigorously pursues Past Due Accounts.

CREDIT CARDS
West Photo Imaging accepts MASTERCARD, VISA and DISCOVER cards. A minimum charge of $15.00 applies.  Customers using this method of payment must be able to provide West Photo Imaging with the billing address and verification code of the card.

COD STATUS
All those on COD Status will be required to pay for their order by Cash, Check, or Credit Card.

SALES TAX
New Jersey State Law requires that SALES TAX WILL BE CHARGED ON ALL SALES UNLESS WE HAVE ON FILE, AT THE TIME OF THE SALE, A FULLY EXECUTED SALES TAX EXEMPTION CERTIFICATE.  Click on the following links to download a copy of the appropriate certificate.
ST-3 (Resale)
        ST-4 (Exempt Use)        ST-5 (Exempt Organization).

RETURNED CHECKS
Any customer check returned as uncollectable to West Photo Imaging will be subject to a MINIMUM fee of $25.00. Payment to cover the cost of the returned check plus this fee MUST be made within 5 days of notification of the customer by West Photo Imaging.  The customer's bad check will be returned to the customer after payment in full has been received by West Photo Imaging and the funds have been credited to the account of West Photo Imaging (cash payments on bad checks will circumvent this waiting period.)


Scheduling

WORKING DAYS are defined as days in-house during the normal work week; a day comprising a 24 hour time period starting at the time the job is actually received in-house and ending at the same time 24 hours later during the normal work week. For the purpose of determining in-house production schedules, orders received after 3:00 pm will be considered as being received the following work day. Time for messenger pick-up and delivery does not count as working time.

WORKING TIMES for services are available ONLY as production schedules permit. If your order requires a specific due date and/or time, it must be stated in writing at the time of original order, even though it may fall within our Normal Service times as indicated for each service. If we find that production falls behind schedule due to unforeseen circumstances, we will do our best to first fulfill those orders that have a specific delivery date and time.

RUSH SERVICE is available ONLY as production schedules permit. Call us first for information on availability and additional charges. There is a $100.00 minimum on work requiring RUSH Service.

OVERTIME will be charged for any work requiring production after normal business hours to meet customer imposed deadlines.  Overtime charges are time charges and are in addition to any RUSH charges on the actual product.
(Example:  Files are received from customer at 5:00 pm on a Monday.  Customer needs photocomposition of files and a final Pictrography 3000 print by 9:00 am the next day.  Job will require 3 hours of computer time.  Customer will be charge for 3 hours of Weekday Overtime at the rate of $150.00 per hour, plus the cost of the Pictrography 3000 print produced at Super Rush Service of $54.00.  Total charges: $450.00 + $54.00 = $506.00 plus sales tax and any delivery fees required to return job to client.)

Weekday Overtime Rate: $ 150.00 per hr. (5:00 pm to 9:00 am, Mon-Thurs,
1 hour min. charge)
Weekend Overtime Rate: 200.00 per hr. (5:00 pm Fri to 9:00 am Mon,
1 hour min. charge)
Holiday &
Holiday-Weekend OT:
300.00 per hr. (Applies to all Holidays and Holiday Weekends,
3 hours min. charge)


Pick-Up & Delivery

West Photo Imaging ships via Federal Express. Check with us for these charges. Additional packing charges may apply depending upon the item being shipped.

On jobs requiring special pick-up and/or delivery arrangements, West Photo Imaging may utilize, with customer approval, a door-to-door messenger service. Tariffs for this service will be charged to your invoice at the prevailing rates.

West Photo Imaging does not ship COD. Customers not on Open Account status are expected to pay for their order at time of pickup. If an order must be shipped, the customer must pre-pay for any work (and its shipping charges) that will be shipped to them, or handle payment by Credit Card.  West Photo Imaging will package a job according to how it will be shipped and can assume no liability for the condition in which it is received. Liability rests with the carrier.
